Sales executive wins £25,000


AN advertising sales executive has been awarded nearly £25,000 after Birmingham Employment Tribunal decided that she had been badly treated because of her pregnancy.

Tracey Callaghan, of Cook Hill, Alcester, had made claims at the tribunal for sex discrimination and constructive unfair dismissal against the advertising firm of Aroq Ltd, of Bromsgrove.

Mrs Callaghan, who had worked for the firm for at least three years, alleged that the company’s attitude caused her to leave and that the trouble started after she announced she was pregnant.

She complained that she was given fewer people to deal with, humiliated every day, claimed to have said things she hadn’t, shouted at and not allowed to work flexible hours.

She alleged that the more she confronted people about their behaviour, the more she became concerned about putting her baby at risk.

The firm had opposed the compensation claims and denied she had been discriminated against because of her sex.

The tribunal had adjourned a previous hearing.

At the latest hearing tribunal chairman Mary Cocks said Mrs Callaghan had been successful with both claims and awarded her £24,851.

The amount included £11,000 for injury to her feelings and interest, said Ms Cocks.

“Mrs Callaghan worked in a sad and unfriendly environment during her pregnancy, which affected her,” said Ms Cocks.

“She was harassed, humiliated and embarrassed in an open plan office. She lost confidence and became upset and shocked by the unjust criticism aimed at her. She realised she was not wanted.”

Jim Tindle, representing Mrs Callaghan, had earlier told the tribunal that Mrs Callaghan had been ‘driven out’ by the firm.

Mr Tindle had previously requested compensation totalling £32,000 for his client. Mrs Callaghan has since had a baby boy.
