POLICE have confirmed no arrests have been made as investigations continue into alleged breaches to planning conditions by a developer.

In February, Bellway Homes won its appeal to the Planning Inspectorate, which overturned a decision by Warrington Borough Council to refuse a planning application.

It meant the developer could build 64 homes at Tanyard Farm in Lymm, off Rushgreen Road, which is in the green belt.

But the council and police launched investigations after work started following alleged breaches to planning conditions – including the potential disturbance of active badger setts.

Cheshire Police has confirmed enquiries are ongoing and no arrests have been made at this stage.

An environmental specialist, who lives close to the site but wishes to remain anonymous, has been pressing the council on a number of issues, including on matters related to asbestos.

In a recent e-mail sent to the resident by an officer in the council’s environmental protection team, seen by the Warrington Guardian, the officer said: “While it is ultimately a matter for the developer and their consultants to ensure that a site is suitable for use having regard to appropriate guidance, the council recognises its role in protecting the public and the environment.

“I can confirm that asbestos material was identified at five locations across the site within five out of 19 samples. It was assumed on this basis to be present across the site.

“The remediation strategy made provision for the delineation, excavation and treatment as required, depending on the sensitivity of the proposed site use and extent of cover system.

“As stated, the council has assessed the information provided by the developer in accordance with the condition and we will continue to liaise with them to ensure that the remediation works are completed.”

A council spokesman says it is ‘not uncommon for sites with a previous historic use’ to require an element of clean-up prior to development, in line with national guidance.

He added: “The developer has undertaken a survey, carried out clean-up works on the site and are in the process of submitting further information to us. We will continue to review the works.”

Bellway Homes has not responded to a request for a comment.
